PART I - PRELIMINARY

Citation

1. These Regulations may be cited as the National Measurement Regulations.*1* SEE NOTES TO FIRST ARTICLE OF THIS CHAPTER .

Interpretation

3. (1) In these Regulations, unless the contrary intention appears:

"the Act" means the National Measurement Act 1960;

"time interval" means time interval not related to the calendar;

"verifying authority", in relation to the verification of a standard of measurement, means a person who is a verifying authority in relation to the verification of such a standard of measurement by virtue of an appointment under regulation 77.

(3) For the purposes of these Regulations, a symbol specified in Column 4 of a Schedule that is formed by the algebraic combination of symbols of other units may also be expressed using appropriate negative exponents.

Division 1 - Length

NATIONAL MEASUREMENT REGULATIONS - REG 4

Units of measurement of length

4. (1) The units of measurement of length are the units specified in Column 2 of Schedule 1.

(2) A unit of measurement specified in an item in Schedule 1 is related to the metre as specified in Column 3 of that Schedule in that item.

(3) A unit of measurement specified in an item in Schedule 1 may be referred to by the symbol specified in Column 4 of that Schedule in that item.

(4A) The inch, being a unit of measurement equal to (0.914 4) / 36 of a metre, is an additional legal unit of measurement of length for use for the purpose of measurement in relation to:

(a) equipment, being:

(i) automotive tyres or rims;

(ii) equipment used, or intended for use, for the manufacture or

(iii) precision pipes, precision tubes, precision fittings or

precision screw threads;

(iv) equipment manufactured for use as spare parts for equipment

constructed using measurements other than metric measurements;

(v) equipment used, or intended for use, in the manufacture of

equipment referred to in subparagraph (iii) or (iv);

(vi) equipment used, or intended for use, by the Department of

(vii) equipment used, or intended for use, in aviation;

(viii) equipment used, or intended for use, in the electronics

industry; or

(ix) equipment used, or intended for use, in the computer industry;

(b) components of equipment referred to in paragraph (a); or

(c) contracts, dealings or other transactions in respect of equipment or components of equipment referred to in paragraph (a) or (b).

(5) The foot, being a unit of measurement equal to (0.914 4) / 3 of a metre, is an additional legal unit of measurement of length for use for the purpose of measurement in relation to:

(a) altitude in aviation;

(b) vertical separation in aviation;

(c) submarine depth; or

The decibel

75. (1) The decibel is the unit of measurement of:

(a) sound power level;

(b) sound pressure level; and

(c) sound intensity level.

(2) In measuring sound power level in decibels, the number of decibels is the number equal to 10 times the logarithm to the base 10 of the ratio of the sound power in the particular case expressed in watts to a reference sound power of 10 -12 watts.

(3) In measuring sound pressure level in decibels, the number of decibels is the number equal to 20 times the logarithm to the base 10 of the ratio of the root-mean-square sound pressure in the particular case expressed in pascals to a reference sound pressure of 2 x 10 -5 pascals.

(4) In measuring sound intensity level in decibels, the number of decibels is the number equal to 10 times the logarithm to the base 10 of the ratio of the sound intensity in the particular case expressed in watts per square metre to a reference sound intensity of 10 -12 watts per square metre.

(5) The decibel may be referred to by the symbol "dB".

76A. The sievert is the dose equivalent or dose equivalent index where:

(a) an absorbed dose of ionizing radiation equal to one gray is delivered to a biological material; and

(b) the conditions under which the dose is delivered satisfy the formula:

Q x N = 1

where:

Q is a factor that is the quality factor representing the effect on the detriment of the microscopic distribution of absorbed energy; and

N is a factor that is the product of all other modifying factors specified by the International Commission on Radiological Protection as at the commencement of these Regulations;

being in each case a factor having the value specified by that Commission as at the commencement of these Regulations.

NATIONAL MEASUREMENT REGULATIONS - PART III

PART III - STANDARDS OF MEASUREMENT

NATIONAL MEASUREMENT REGULATIONS - REG 77

Verifying authorities

77. (1) The Commission may, by instrument in writing, appoint a person (including a body corporate) to be a verifying authority in relation to the verification of standards of measurement as reference standards of measurement.

(2) An appointment under this regulation may be an appointment of the person for the time being holding, or performing the duties of, a specified office of:

(a) the Commonwealth, a State or a Territory; or

(b) a body corporate.

(3) An appointment under this regulation may be in relation to the verification of standards of measurement generally or the verification of the standards of measurement included in a particular class or particular classes of standards of measurement.

NATIONAL MEASUREMENT REGULATIONS - REG 78

Marks to be stamped on or affixed to standards of measurement

78. (1) Subject to this regulation, a standard of measurement shall not be verified under these Regulations unless:

(a) a distinguishing mark has been stamped or otherwise legibly and permanently affixed on or to it before it is verified; or

(b) there is stamped or otherwise legibly marked on or affixed to it, immediately after it has been verified or reverified, a mark indicating the date on which it was verified and, if such is the case, that it is to be deemed to be of a value equal to its denomination in accordance with regulation 82.

(2) Subregulation (1) does not apply in relation to a standard of measurement if it is impracticable, by reason of its size or nature, so to stamp or affix a mark referred to in paragraph (1) (a) or (b) on or to it.

NATIONAL MEASUREMENT REGULATIONS - REG 78A

Verification etc. of standards of measurement referred to in section 8

of the Act

78A. (1) Where a standard of measurement referred to in section 8 of the Act is verified:

(a) in the case of a verification carried out by the Organisation - an officer or employee of the Organisation authorized by the Organisation in writing to sign and issue certificates under this regulation; or

(b) in any other case - any person authorized by the Organisation in writing to sign and issue certificates under this regulation;

may sign and issue such a certificate with respect to the verification of the standard of measurement.

(2) There shall be stated in every such certificate:

(a) the date on which the standard of measurement was verified;

(b) the accuracy with which the standard was verified;

(c) a description of the mark (if any) appearing on the standard as referred to in regulation 78;

(d) the value, in terms of an Australian legal unit of measurement or of Australian legal units of measurement, of the standard as ascertained on the date referred to in paragraph (a); and

(e) that the standard is an Australian primary standard of measurement or an Australian secondary standard of measurement, as the case may be.

(3) For the purposes of paragraph (2) (b), the accuracy of the standard of measurement shall be ascertained and expressed in a manner authorized by a determination of the Organisation for the purposes of this regulation or, if more than one manner is authorized in such a determination, in one of the manners so authorized.

NATIONAL MEASUREMENT REGULATIONS - REG 79

Verification etc. of State primary standards of measurement

79. (1) Where a standard of measurement to which section 9 of the Act applies is verified in accordance with that section:

(a) in the case of a verification carried out by the Organisation - an officer or employee of the Organisation authorized by the Organisation in writing to sign and issue certificates under this regulation; or

(b) in any other case - any person authorized by the Organisation in writing to sign and issue certificates under this regulation;

may sign and issue such a certificate with respect to the verification of the standard of measurement.

(2) There shall be stated in every such certificate:

(a) the date on which the standard of measurement was verified;

(b) the accuracy with which the standard was verified;

(c) a description of the mark (if any) appearing on the standard as referred to in regulation 78;

(d) the value, in terms of an Australian legal unit of measurement or of Australian legal units of measurement, of the standard as ascertained on the date referred to in paragraph (a);

(e) the period specified under subsection 9 (3) of the Act as the period within which the standard is to be verified again; and

(f) that the standard was verified in accordance with section 9 of the Act.

(3) For the purposes of paragraph (2) (b), the accuracy of the standard of measurement shall be ascertained in a manner authorised by a determination of the Organisation for the purposes of this regulation or, if more than one manner is authorised in such a determination, in one of the manners so authorised.

(4) For the purposes of paragraph (2) (b), the accuracy of the verification of a State primary standard of measurement must be expressed as an uncertainty that does not exceed:

(a) in the case of a State primary standard for the measurement of length that is of a denomination referred to in Column 1 in Schedule 31 - the amount of permissible uncertainty specified in Column 2 in that Schedule in relation to that denomination; or

(b) in the case of a State primary standard for the measurement of mass that is of a denomination referred to in Column 1 in Schedule 31A - the amount of permissible uncertainty specified in Column 2 in that Schedule in relation to that denomination; or

(c) in the case of a State primary standard for the measurement of mass that is of a denomination not referred to in Column 1 in Schedule 31A - the amount of permissible uncertainty appropriate to that denomination when the mathematical method known as linear interpolation is applied to the amounts of permissible uncertainty specified in Column 2 in that Schedule.

(5) For the purposes of paragraph (2) (d), the value of the standard of measurement is the value ascertained under standard reference conditions of 20 degrees Celsius temperature and 101.325 kilopascals pressure.

NATIONAL MEASUREMENT REGULATIONS - REG 80

Verification of reference standards of measurement

80. (1) The verification of a standard of measurement as a reference standard of measurement for the purposes of the Act shall be carried out:

(a) by the Organisation;

(b) by an appropriate verifying authority being a body corporate; or

(c) by, or under the supervision of, an appropriate verifying authority not being a body corporate;

in accordance with this regulation.

(2) The verification shall be carried out in a manner that, having regard to the nature of the standard to be verified, is appropriate for the purpose.

(3) Where a standard of measurement is verified as a reference standard of measurement by the Organisation, the Organisation or an officer or employee of the Organisation authorized by the Organisation in writing for the purposes of this subregulation shall specify the period within which the standard is to be verified again, and the standard shall be verified again within that period.

(4) Where a standard of measurement is verified as a reference standard of measurement by, or under the supervision of, a verifying authority, the standard shall be verified again within such period as the Commission or a person authorized by the Commission in writing for the purposes of this subregulation directs.

(5) A direction by the Commission or a person authorized by the Commission, under subregulation (4) may relate to a particular standard of measurement or to all the standards of measurement included in a particular class of standards of measurement.

(6) Where a standard of measurement is verified in accordance with this regulation:

(a) if the verification is carried out by the Organisation or a verifying authority being a body corporate - an officer or employee of the Organisation or of the verifying authority authorized in writing by the Organisation or the verifying authority, as the case may be, to sign and issue certificates under this regulation; and

(b) if the verification is carried out by, or under the supervision of, a verifying authority not being a body corporate:

(i) the verifying authority; or

(ii) if the Commission empowers the verifying authority to

authorize in writing a person or persons to sign and issue certificates under this regulation, a person so authorized;

may sign and issue a certificate under this regulation.

(7) There shall be stated in every such certificate:

(a) the date on which the standard of measurement was verified;

(b) the accuracy with which the standard was verified;

(c) a description of the mark (if any) appearing on the standard as referred to in regulation 78;

(d) the value, in terms of an Australian legal unit of measurement or of Australian legal units of measurement, of the standard as ascertained on the date referred to in paragraph (a);

(f) the period within which the standard is to be verified again; and

(g) that the standard was verified as a reference standard of measurement:

(i) by the Organisation; or

(ii) by, or under the supervision of, a specified verifying

authority;

in accordance with these Regulations.

(8) For the purposes of paragraph (7) (b), the accuracy of the standard of measurement shall be ascertained in a manner authorised by a determination of the Commission for the purposes of this regulation or, if more than one manner is authorised in such a determination, in one of the manners so authorised.

(9) For the purposes of subregulation (8), the Commission may, from time to time, determine the manner or manners in which the accuracy of a reference standard of measurement shall be ascertained.

(10) Notice of a determination made under subregulation (8) shall be given, by or on behalf of the Commission, to all verifying authorities that have been appointed verifying authorities in relation to a standard of measurement to which the determination relates.

(11) For the purposes of paragraph (7) (b), the accuracy of the verification of a State secondary standard of measurement must be expressed as an uncertainty that does not exceed:

(a) in the case of a State secondary standard for the measurement of length that is of a denomination referred to in Column 1 in Schedule 31 - the amount of permissible uncertainty specified in Column 3 in that Schedule in relation to that denomination; or

(b) in the case of a State secondary standard for the measurement of mass that is of a denomination referred to in Column 1 in Schedule 31A - the amount of permissible uncertainty specified in Column 3 in that Schedule in relation to that denomination; or

(c) in the case of a State secondary standard for the measurement of volume that is of a denomination referred to in Column 1 in Schedule 31B - the amount of permissible uncertainty specified in Column 2 in that Schedule in relation to that denomination; or

(d) in the case of a State secondary standard for the measurement of mass or volume that is of a denomination not referred to in Column 1 in Schedule 31A or 31B - the amount of permissible uncertainty appropriate to that denomination when the mathematical method known as linear interpolation is applied to the amounts of permissible uncertainty specified:

(i) in the case of a standard for the measurement of mass - in

Column 3 in Schedule 31A; or

(ii) in the case of a standard for the measurement of volume - in

Column 2 in Schedule 31B.

(12) For the purposes of paragraph (7) (b), the accuracy of the verification of a State tertiary standard of measurement must be expressed as an uncertainty that does not exceed:

(a) in the case of a State tertiary standard for the measurement of mass that is of a denomination referred to in Column 1 in Schedule 31A - the amount of permissible uncertainty specified in Column 4 in that Schedule in relation to that denomination; or

(b) in the case of a State tertiary standard for the measurement of volume that is of a denomination referred to in Column 1 in Schedule 31B - the amount of permissible uncertainty specified in Column 3 in that Schedule in relation to that denomination; or

(c) in the case of a State tertiary standard for the measurement of mass or volume that is of a denomination not referred to in Column 1 in Schedule 31A or 31B - the amount of permissible uncertainty appropriate to that denomination when the mathematical method known as linear interpolation is applied to the amounts of permissible uncertainty specified:

(i) in the case of a standard for the measurement of mass - in

Column 4 in Schedule 31A; or

(ii) in the case of a standard for the measurement of volume - in

Column 3 in Schedule 31B.

(13) For the purposes of paragraph (7) (b), the accuracy of the verification of an Inspectors' Class 1 standard of measurement must be expressed as an uncertainty that does not exceed:

(a) in the case of an Inspectors' Class 1 standard for the measurement of length that is of a denomination referred to in Column 1 in Schedule 32 - the amount of permissible uncertainty specified in Column 2 in that Schedule in relation to that denomination; or

(b) in the case of an Inspectors' Class 1 standard for the measurement of area that is of a denomination referred to in Column 1 in Schedule 32A - the amount of permissible uncertainty specified in Column 2 in that Schedule in relation to that denomination; or

(c) in the case of an Inspectors' Class 1 standard for the measurement of mass that is of a denomination referred to in Column 1 in Schedule 32B - the amount of permissible uncertainty specified in Column 2 in that Schedule in relation to that denomination; or

(d) in the case of an Inspectors' Class 1 standard for the measurement of volume that is of a denomination referred to in Column 1 in Schedule 32C - the amount of permissible uncertainty specified in Column 2 in that Schedule in relation to that denomination; or

(e) in the case of an Inspectors' Class 1 standard for the measurement of area, mass or volume that is of a denomination not referred to in Column 1 in Schedule 32A, 32B or 32C - the amount of permissible uncertainty appropriate to that denomination when the mathematical method known as linear interpolation is applied to the amounts of uncertainty specified:

(i) in the case of a standard for the measurement of area - in

Column 2 in Schedule 32A; or

(ii) in the case of a standard for the measurement of mass - in

Column 2 in Schedule 32B; or

(iii) in the case of a standard for the measurement of volume - in

Column 2 in Schedule 32C.

(14) For the purposes of paragraph (7) (b), the accuracy of the verification of an Inspectors' Class 2 standard of measurement must be expressed as an uncertainty that does not exceed:

(a) in the case of an Inspectors' Class 2 standard for the measurement of length that is of a denomination referred to in Column 1 in Schedule 32 - the amount of permissible uncertainty specified in Column 4 in that Schedule in relation to that denomination; or

(b) in the case of an Inspectors' Class 2 standard for the measurement of mass that is of a denomination referred to in Column 1 in Schedule 32B - the amount of permissible uncertainty specified in Column 4 in that Schedule in relation to that denomination; or

(c) in the case of an Inspectors' Class 2 standard for the measurement of mass that is of any other denomination - the amount of permissible uncertainty appropriate to that denomination when the mathematical method known as linear interpolation is applied to the amounts of permissible uncertainty specified in Column 4 in that Schedule.

(15) For the purposes of paragraph (7) (b), the accuracy of the verification of an Inspectors' Class 3 standard of measurement must be expressed as an uncertainty that does not exceed:

(a) in the case of an Inspectors' Class 3 standard for the measurement of mass that is of a denomination referred to in Column 1 in Schedule 32B - the amount of permissible uncertainty specified in Column 6 in that Schedule in relation to that denomination; or

(b) in the case of an Inspectors' Class 3 standard for the measurement of mass that is of any other denomination - the amount of permissible uncertainty appropriate to that denomination when the mathematical method known as linear interpolation is applied to the amounts of permissible uncertainty specified in Column 6 in that Schedule.

(16) For the purposes of paragraph (7) (d), the value of the standard of measurement must be:

(a) the value ascertained under standard reference conditions of 20 degrees Celsius temperature and 101.325 kilopascals of pressure; or

(b) in respect of a standard of measurement of a substance or thing in relation to which reference conditions are specified in a determination of the Commission under subregulation (17), the value ascertained under those conditions.

(17) For the purposes of paragraph (16) (b), the Commission may, from time to time, determine the conditions under which the value of a reference standard of measurement for a particular substance or thing shall be ascertained.

(18) Notice of a determination made under subregulation (17) must be given by, or on behalf of, the Commission, to each verifying authority that is a verifying authority in relation to a reference standard of measurement to which the determination relates.

(19) In this regulation:

"verifying authority" includes any person authorised by the Organisation to sign and issue certificates:

(a) under paragraph 78A (1) (b); or

(b) under paragraph 79 (1) (b).

NATIONAL MEASUREMENT REGULATIONS - REG 80

Certificates as evidence

80A. (1) A certificate issued under this Part is evidence of the matters stated in it.

(2) A document purporting to be such a certificate may be received in evidence in any court (whether exercising federal jurisdiction or not) or in proceedings before a person authorized by a law of a State or Territory of the Commonwealth, or by consent of parties, to hear, receive and examine evidence.

(3) A certificate purporting to be a certificate under this Part or a document purporting to be a document cancelling a certificate under this Part shall, unless the contrary is proved, be deemed to have been signed and issued by the person by whom it purports to have been signed and issued and, unless the contrary is proved, the person by whom it purports to have been signed and issued shall be deemed to be a person authorized by, or in pursuance of, this Part to sign and issue the certificate or document.

NATIONAL MEASUREMENT REGULATIONS - REG 81

Cancelling of certificates

81. (1) A certificate issued under regulation 78A or 79 may be cancelled at any time by the Organisation or by a person authorized in writing to do so by the Organisation.

(2) A certificate issued under regulation 80 may be cancelled at any time:

(a) in the case of a certificate issued by an officer or employee of the Organisation - by the Organisation or by a person authorized in writing to do so by the Organisation; or

(b) in the case of a certificate issued by a verifying authority referred to in regulation 80, an officer or employee of such a verifying authority or a person empowered by such a verifying authority under subparagraph 80 (6) (b) (ii) to sign and issue certificates:

(i) by the Commission; or

(ii) by the verifying authority; or

(iii) by a person authorised in writing by the Commission to cancel

a certificate of that kind.

(3) Where a certificate is cancelled in pursuance of this regulation, the body or person cancelling the certificate shall sign and issue a document stating that the certificate has been cancelled or, if the certificate is in the possession of the body or person, endorse on it the word "Cancelled" and the date of cancellation.

NATIONAL MEASUREMENT REGULATIONS - REG 82

Permissible variation in certain reference standards of measurement

82. (1) Subject to subregulation (3), a standard for the measurement of length, area, mass or volume, being an Inspectors' Class 1 standard of measurement, an Inspectors' Class 2 standard of measurement or an Inspectors' Class 3 standard of measurement, that, on verification, is found not to be inaccurate by an amount exceeding the relevant permissible variation in relation to its denomination has, for the purposes of the certificate referred to in regulation 80, a value equal to that denomination.

(2) For the purposes of subregulation (1), "relevant permissible variation" means:

(a) in the case of an Inspectors' Class 1 standard for the measurement of length, area, mass or volume that is of a denomination referred to in Schedule 32, 32A, 32B or 32C (as the case requires) - the amount specified in Column 3 in that Schedule in relation to that denomination; or

(b) in the case of an Inspectors' Class 1 standard for the measurement of area, mass or volume that is not of a denomination referred to in Column 1 in Schedule 32A, 32B or 32C - the amount appropriate to that denomination when the mathematical method known as linear interpolation is applied to the amounts of permissible variation specified:

(i) in the case of a denomination of area - in Column 3 in Schedule

32A; or

(ii) in the case of a denomination of mass - in Column 3 in

Schedule 32B; or

(3) A standard of measurement referred to in this regulation must not be taken to have a value equal to the value of a particular denomination of length, area, mass or volume, unless the accuracy with which that standard is verified is of an uncertainty that does not exceed the amount of permissible uncertainty referred to in respect of that denomination:

(a) in the case of an Inspectors' Class 1 standard of measurement - in subregulation 80 (13); or

(b) in the case of an Inspectors' Class 2 standard of measurement - in subregulation 80 (14); or

(c) in the case of an Inspectors' Class 3 standard of measurement - in subregulation 80 (15).

(2) For the purposes of section 11 of the Act, the conversion factor specified in Column 4 of an item in Schedule 34 is prescribed for the purpose of converting a measurement of a physical quantity expressed in terms of a unit of measurement of that physical quantity specified in Column 2 of that item to a measurement expressed in terms of the Australian legal unit of measurement specified in Column 3 of that item.
