There is currently a large disparity in negotiated overhead across universities (particularly for NIH, and apparently across departments for DOD). It would be good if the overhead were a set constant so that all universities (and all departments) were playing on a more even ground. A cap set by the government is unlikely to be the best option, but a (negotiated) set percentage independent of the university itself would certainly be more fair.
